If you are a fan of Alex Kozinski’s writing — and, frankly, who isn’t? — don’t miss his dissent in United States v. I.E.V., an opinion issued earlier today. It’s not often that one sees an appellate opinion that uses three exclamation points (!!!) to emphasize a point.
UPDATE: Though his I.E.V. dissent is an instant classic, my favorite Kozinski quip remains the following bon mot, from a dissent from a denial of rehearing en banc a decade ago: “The panel’s labored effort to smother the Second Amendment by sheer body weight has all the grace of a sumo wrestler trying to kill a rattlesnake by sitting on it–and is just as likely to succeed.”
